Having the problems that lead you to file a Chapter 13 Bankruptcy, such as a pending foreclosure can keep you up nights worrying! Bankruptcy is a proceeding under the authority of the U.S. government. Federal proceedings are complicated and should be taken seriously. Filing Bankruptcy involves more than just meeting with your attorney and signing a few papers. Just as you wouldn't want to undergo an IRS audit without competent representation, you want a Bankruptcy attorney with the necessary skills and experience. A Chapter 13 is one of the more complicated procedures in Bankruptcy. An experienced attorney can provide the guidance so that you won’t have to worry about the complications.

The fee for legal services is regulated by the Court. Most attorneys charge the same fee for handling a Chapter 13. The Court filing fee is $274.00. The difference is how much you have to "put down" to get your case filed and what is included. I believe that the down payment I require to get your case filed is very reasonable. My base fee includes:

Free online pre-bankruptcy filing Credit Counseling
Free Credit Report
Free Credit Rebuilding kit after successful completion of case.
There may be other charges and fees for services not included in basic package.

Things You Must Do Before Coming In

1
Prepare all income taxes you are legally obligated to file, especially those old taxes. You don’t have to file the taxes, and you don’t have to even think about paying the taxes, but you do have to get all returns prepared. The returns don’t have to be perfect, but everything in it must be truthful.

2
Bring in the following documents with you to the first visit to my office:

A Your ID such as a Drivers license and your Social Security card
B Tax Returns - past 4 years
C Paystubs - the last 6 months (please provide a complete set of your paystubs, or a printout from your Payroll office)
D Paystubs for Spouse - the last 6 month (even if not filing)
E Payment Coupons for Car(s) & Mortgages
F Lawsuits/Judgment(s)/Garnishment(s)/Foreclosure paperwork
G Divorce Decree if divorced within past 3 years
3 Know where you are spending your income and be ready to tell me about it.

4
Make a list of who you owe and how much you owe. Open your bills and look at them. Some people just cannot bring themselves do this, and we understand. If you prefer, give us your bills and we will open them, look at them, and tell you how bad it is. However, there is an additional cost for this service.

5
If you want me (or any lawyer) to work for you, you need to pay. Until you start paying your attorney, nothing will happen!

6
If you want me (or any lawyer) to help you, you must tell the truth. Don’t be embarrassed to be completely candid about discussing your money problems. We’ve heard it all before, from the person who hasn’t filed taxes in ten years to the lady who spent over $200,000 gambling in the last year! You don’t need to apologize about having made mistakes if you are ready to learn from these mistakes.

7
Don’t waste your time and money getting a credit report because I will get your credit report online as part of preparing your Bankruptcy. For your required pre-Bankruptcy credit counseling please follow the following link.
